North Penn Legal Services, Inc. provides legal services in civil cases to low income people in Northeastern Pennsylvania. A series of self-help custody packets have been developed to assist in that process. The packets contain instructions and forms.
The packets are designed for cases whose jurisdiction lies in Lycoming County. Generally, those would be cases where the children live in Lycoming County and have lived there for at least six months.
Complaint For Custody Kit: This packet is designed to enable people to file a custody action in Lycoming County Court and represent themselves when they are not able to afford the services of a private attorney and do not qualify for Legal Services. It is designed to be used by parents seeking custody of children or seeking partial custody (visitation). In some instances grandparents and others serving in Loco Parentis may be eligible to file for custody and/or visitation. It is designed for the filing of initial actions in custody, meaning that there hasn’t been any custody action filed before. This is not designed for cases where there is an order in another state or county.
Modification of Custody Kit: If there is already a Custody Order in Lycoming County and you want to change that Order, this packet is designed to enable people to file to change their Custody Order when both parties are not in agreement.
Contempt of Custody Kit: If there is a Custody Order in Lycoming County involving the children and you feel the other side has disobeyed that Order, this packet is designed to enable people to file a Contempt of Court.
Custody Stipulation/Modification Kit: If both parents agree as to who would have custody and/or partial custody and wish to have that agreement signed by a judge and made into a Custody Order in Lycoming County, this packet is designed for that purpose. Also, this packet can be used to change a Custody Order when both parties are in agreement.
Emergency or Special Custody Relief Self-help Kit: The information, forms, and instructions in this packet will allow you to file on your own (pro se) the appropriate documents to request the Court grant emergency relief to protect the child(ren) “from an immediate clear and present danger”.
